Family of dead San Antonio man sues St. Luke’s hospital; alleges nurse assaulted cancer patient

The family of a San Antonio man who died in July filed a wrongful death lawsuit on Tuesday against St. Luke’s Baptist Hospital, alleging that he was attacked by a nurse there.

The lawsuit alleges that a male nurse who was helping 65-year-old Bobby Garner after he had received treatment for a cancerous mass in his neck became angry with Garner because he was taking too long in the bathroom.

Garner’s family says in the lawsuit that the nurse, who is not identified in the complaint, pulled Garner by the shoulder from the toilet and hurled him onto the bed. The family alleges that the assault resulted in paralysis and led to Garner’s death weeks later.
